ModMed Furniture & Lighting ("ModMed", "we", "us", "our") is an independent furniture, upholstery, and lighting sales representative agency serving the furniture trade in New England. This policy explains what personal information we collect through modmedfurniture.com, why we collect it, who we share it with, how long we keep it, and the rights you have over it.
ModMed is the controller of the personal information described here. You can reach us using the contact details at the end of this policy.
Information we collect
Information you give us. When you submit our inquiry form, we receive:
- Your name
- Your company or business name
- Your business type (interior designer, retailer, showroom, or other)
- Your business email address (required, so we can reply)
- Your phone number (optional)
- The message you write to us
If you email or call us directly, we receive whatever contact details and content you include in that message.
Information collected automatically. Our hosting provider processes standard server log data — such as IP address, browser type, referring page, and timestamps — to deliver pages, prevent abuse, and keep the site secure. We do not use this data to build profiles, and we do not run advertising or cross-site tracking. See our Cookies Policy.
We do not knowingly collect special-category or sensitive personal information, government identifiers, or payment card details through this site. Please do not send them to us.
Why we use it, and our legal bases
- To respond to your inquiry and discuss the lines we represent, collections, samples, and availability. Legal basis: performance of a contract or steps taken at your request, and our legitimate interest in conducting business-to-business communication.
- To maintain an ongoing trade relationship with your business, including follow-up on open questions and quotes. Legal basis: legitimate interests.
- To operate, secure, and troubleshoot the site. Legal basis: legitimate interests.
- To meet legal, tax, and record-keeping obligations. Legal basis: compliance with a legal obligation.
This is a business-to-business site. We do not sell to consumers, and we do not process orders or payments here. We do not use your information for automated decision-making or profiling that produces legal effects, and we do not use it for unrelated marketing without your consent.
How we share it
We do not sell or share your personal information, and we do not rent or trade it. In the past twelve months we have not sold personal information or shared it for cross-context behavioral advertising. We disclose information only as follows:
- Manufacturers we represent — currently Primo International and Elegant Furniture & Lighting — where sharing relevant details of your inquiry is necessary to answer your request, route a quote, or open an account on your behalf.
- Service providers acting on our instructions (see below).
- Legal and safety disclosures where required by law, legal process, or to protect our rights, and in connection with a business transfer.
Service providers
We use a small number of vendors to run this site, each processing data only to provide their service to us:
- Website hosting and content delivery — serving and securing the site.
- Managed cloud database — storing inquiry form submissions.
- Transactional email delivery — sending your inquiry to us as a notification email so we can reply.
These providers are bound by contract to protect your information and are not permitted to use it for their own purposes.
International transfers
We operate in the United States and our providers may process data in the United States or other countries. If you contact us from the European Economic Area, the United Kingdom, or Switzerland, your information will be transferred to the United States. Where required, such transfers rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses. You may request more information using the contact details below.
Data retention
We keep inquiry submissions and related correspondence for up to three years after our last substantive contact with you, unless a longer period is needed to meet legal, tax, or record-keeping obligations or to resolve a dispute. Server logs are retained by our hosting provider for a short period for security purposes. After that, records are deleted or anonymized.
Security
Submissions are transmitted over an encrypted (HTTPS) connection and stored in a database with access restricted to ModMed and, where necessary, our providers. We review access and keep collection to the minimum needed. No method of transmission or storage can be guaranteed to be completely secure.
Your rights
Depending on where you live, you may have the right to request access to the personal information we hold about you, to correct it, to delete it, to receive a portable copy, to restrict or object to certain processing, and to withdraw consent where we rely on it. You also have the right not to be discriminated against for exercising these rights.
Residents of California, Colorado, Connecticut, Virginia, and other U.S. states with comprehensive privacy laws may exercise the rights available to them, including the right to opt out of sale or targeted advertising — which we do not engage in. Because this is a business-to-business site, some U.S. state laws may not apply to information collected in a commercial context; we will honor reasonable requests regardless.
To make a request, or to appeal a decision on a request, email tomas@modmedfurniture.com. We will verify your request against the information you submitted and respond within the time required by applicable law (generally 45 days in the U.S. and one month under the GDPR). An authorized agent may submit a request on your behalf with written permission. If you are in the EEA or UK, you may also lodge a complaint with your local supervisory authority.
Do Not Track and global privacy signals
We do not track users across third-party websites, so we do not respond differently to Do Not Track or Global Privacy Control signals. If that changes, we will update this policy.
Children
This site is intended for furniture trade professionals and is not directed to children under 16. We do not knowingly collect information from children. If you believe a child has submitted information, contact us and we will delete it.
